Haxtun Town Council's property sale proposal under review by attorney

The sale of Town-owned property was the topic of a special meeting held last Monday, March 8. The Haxtun Town Council entered into executive session for the first half hour of the meeting to discuss the sale of Town-owned property including shop, truck barn, lean-to and parking lot behind town hall and library to Haxtun Health.

The special meeting follows one from the week before in which the Council voted to sell the property outlined above for a sum of $200,000. However, follow-up with the Town’s attorney forced council members to rescind their original motion.

The Council has since come up with a different proposal for the sale of the property. That proposal is currently in review by the Town’s attorney.

According to Colorado Revised Statues, a municipality may not sell property in use or occupied, which caused the hiccup in the original motion made by the Haxtun Town Council on March 8 as the Town currently occupies the shop and truck barn.

Following the executive session last week, and after rescinding the original motion, the Council has since come up with a proposal for Haxtun Health which includes all of the same properties, for the same amount, but in a different fashion.

The proposal on the table now includes the sale of everything in the original plan with the exception of the shop. The proposal includes the truck barn and lean-to as well as property 20 feet back from town hall and the library to Haxtun Health for $200,000. The proposal stipulates a 30 foot utility easement for the Town of Haxtun, located directly behind the library. Haxtun Health would be responsible for demolition of the buildings as well as any necessary land surveys. Haxtun Health plans to use the land to allow for parking at their new building along Colorado Avenue, in the old Smith Hardware building.

The last part of the proposal includes the Town of Haxtun vacating the shop within 24 months and then donating the building and land to Haxtun Health.

Once the Town’s attorney has a chance to review the current proposal from the Town of Haxtun it will be passed along to Haxtun Health for consideration.
